Federal Council of Germany adopts significant changes in the regulation of heavy goods transport

In its session held on 6 November 2020, the Federal Council of Germany corrected and improved the planned amendment to the StVO (German Highway Code) in favour of the heavy goods transport sector.

After the amendment had initially stipulated that applications for heavy goods transport would in future have to be submitted exclusively to the respective competent authority at a transport’s place of departure and destination, the chamber of the federal states has now backtracked – in reaction to vehement and vociferous protests from industry circles – and amended § 47 StVO with effect from 01 January 2021.

AN IMPORTANT PARTIAL SUCCESS

The revised regulation stipulates that applications for heavy goods transport are once again, as before, the responsibility of the authority in whose district the executing company has its headquarters or can prove that it has a branch office.
